ORDINANCE TITLE:
Ordinance Number 2023-16
An ordinance relating to the sale and exchange of city property; providing definitions; establishing procedures for the sale or exchange of city-owned real property and non-real property; establishing monetary thresholds for the determination of the applicable procedure for the sale or exchange of real property and non-real property; establishing alternative procedures for the disposition of real property; providing direction for the codification of this ordinance; repealing all ordinances in conflict; providing for severability; and providing for an effective date.
SUMMARY OF PROPOSED ORDINANCE:
This ordinance provides methods by which the City of Starke may dispose of real property owned by the City of Starke, and procedures in furtherance thereof for the purpose of (a) ensuring the sound disposition of such real property; (b) that the benefits (whether monetary or otherwise) received by the City of Starke in exchange for such real property are in the public interest and further the City of Starke’s objectives; and (c) the disposition of such real property by the City of Starke is conducted in a public and transparent manner.
ESTIMATE OF DIRECT ECONOMIC IMPACT ON PRIVATE ENTERPRISE:
The only direct cost of compliance with this ordinance that must be borne by private enterprises is incurring the cost to develop a narrative to be submitted to the City indicating the current and/or future planned use(s) for the subject real property by the proposed purchaser of such real property. Such cost to comply with this requirement is estimated to be de minimis in nature, although a proposed purchaser may elect to engage third-party professionals to assist in developing such narrative.
A proposed purchaser of real property may also incur certain negotiated contractual transaction costs associated with the closing of the sale and purchase of real property should the City elect to proceed with such sale in its sole discretion.
ESTIMATE OF THE CITY’S REGULATORY COSTS AND REVENUES DERIVED FROM FEES IMPOSED:
The City is anticipated to have no regulatory costs associated with this ordinance. Notwithstanding, the City will have certain costs of compliance to perform internal surveys of City departments; engage appraisers to perform appraisals of the value of real property; and advertising costs to advise the public of contemplated dispositions of real property.
